Penalties can
be severe for contacting an individual who has their phone number on the
National Registry. Fines can be as
high as $11,000.00 per violation, not including private lawsuits.
Phone numbers on the list, specific to OUR AREA CODES can be accessed at:

You can now
enter one area code and up to 10 telephone numbers (7-digit numbers with no
dashes).
Be sure to
read and accept the Certification shown.
Press
“submit” to get results.
By pressing
“Reset” you can do this up to 10 times during each log-in session thus
allowing you to search up to 100 telephone numbers per session.
Be sure to
click on “Log Out” when you are done with your search session – then close
the home page.
For your
convenience, we have an icon for the Do Not Call Registry web site on our Forms
Room Computer. Information is also

Agents and
staff must become familiar with the Federal rules and SRE policies to insure
compliance. Until further
clarification is made it is Southern Realty’s policy that all associates
immediately take steps to ensure that they do not violate the Do Not Call
Federal and State laws and that SRE will not be responsible for any violations
by their associates or staff.
REFERRALS,
OUTGOING
Ideally you should obtain written permission from the individual for the
destination company to call them (sample attached).
If you cannot get written permission you must document you asked their
permission and what they said as well as the time and date.
Our coordinator will require permission documentation before placing any
referral.
REFERRALS,
INCOMING
Our referral coordinator must always verify that the referred person is
expecting to be called when receiving a referral.
When making the initial contact, SRE associates should say “Mr./Mrs.
_______________ - My name is _______________ with Southern Realty and I
understand from (referring associate) that you asked to be contacted
about your relocation to Orlando – Is that correct?”
FOR
SALE BY OWNERS
As a Buyer’s representative you may contact an owner whose number is on
the Registry about a client’s potential interest in their property.
Do not, however, use a purported client’s interest as a way to discuss
the possibility of listing the property.
Currently, NAR is seeking clarification regarding calls to For Sale By
Owners who have placed advertisements or have their phone numbers on yard signs.
Therefore, if these numbers are on the National Registry, refrain from
calling them.
OPEN
HOUSE REGISTRY
Be sure to clearly disclose that visitors are consenting to receive a
follow-up call when they sign the registry and provide a phone number.
EXCEPTIONS
TO THE NATIONAL DO NOT CALL RULE
1. You may call consumers
who are current customers up to 18 months after the transaction.
2. Consumers that call you
can be contacted up to 3 months after the inquiry.
(These
exemptions would end immediately if the consumer is on the list and asks not be
to contacted again).
